Abstract

In light of contemporary circumstances, on the 30th anniversary of the Nicaragua judgment it is worth revisiting and considering again certain legal problems decided by – and raised by – the ICJ judgment. This article addresses the importance of the judgment in terms of international legal regulations on the use of force. First and foremost, the article examines the concept of armed attack based on the “gravity” criterion elaborated by the Court and the exercise of the right of self-defence. Moreover, the relationship between customary international law and treaty law, as well as forcible counter-measures and military actions against non-State actors are also discussed in the article. It is argued that the “gravity” criterion used by the ICJ seems controversial and, consequently, may limit the right of self-defence. On the other hand, however, the judgment established a strong barrier to the realization of individual political interests by militarily powerful States. This is the Nicaragua judgment’s long-lasting legacy. In this sense the judgment has stood the test of time.

Abstract

There are different meanings and functions of what is called a “general principle of law.” This article seeks to address their importance as the basis for the systemic integration of the international legal order. When international law is considered as a legal system, its normative unity and completeness seems essential. This article argues that general principles of law are a necessary, although less visible, element of international legal practice and reasoning, which secure the systemic integration and long-lasting underpinnings of international law. In this sense they may be seen as the gentle guardians of international law as a legal system.

Abstract

This is a survey of Polish-language Jewish newspapers and periodicals published in Galicia prior to 1918 taking into account the general background of multilingual Jewish press in this autonomous province of the Austro-Hungarian Empire. It appears that the total amount of Jewish periodical publications in that period was 182, including 31 in Polish. This survey also attempts to establish the publication frequency and longevity of each periodical and identify the communities or sponsors that supported them.

Abstract

Artykuł charakteryzuje pismo „Moriah” wydawane we Lwowie w latach 1903–1924 jako miesięcznik młodzieży żydowskiej. Pismo ukazywało się w języku polskim i było trybuną środowiska syjonistycznego. „Moriah” zamieszczała teksty popularnonaukowe, głównie z zakresu historii i literatury żydowskiej oraz utwory literackie przedstawicieli literatury jidysz i hebrajskiej. Pismo realizowało model wychowania w duchu narodowo-żydowskim, ale przede wszystkim popularyzowało idee syjonizmu.

Abstract

This article describes queueing systems and queueing networks which are successfully used for performance analysis of different systems such as computer, communications, transportation networks and manufacturing. It incorporates classical Markovian systems with exponential service times and a Poisson arrival process, and queueing systems with individual service. Oscillating queueing systems and queueing systems with Cox and Weibull service time distribution as examples of non-Markovian systems are studied. Jackson's, Kelly's and BCMP networks are also briefly characterized. The model of Fork-Join systems applied to parallel processing analysis and the FES approximation making possible of Fork-Join analysis is also presented. Various types of blocking representing the systems with limited resources are briefly described. In addition, examples of queueing theory applications are given. The application of closed BCMP networks in the health care area and performance evaluation of the information system is presented. In recent years the application of queueing systems and queueing networks to modelling of human performance arouses researchers' interest. Hence, in this paper an architecture called the Queueing Network-Model Human Processor is presented.

Abstract

The paper presents a dynamic analysis of the damaged masonry building repaired with the Flexible Joint Method. Numerical analysis helped to determine the effect of the applied repairing method on natural frequencies as well as values of stresses and accelerations in the analyzed variants of numerical model. They confirmed efficiency of the proposed repair method.

Abstract

The modified air gap torque method to determine the efficiency of squirrelcage induction motor was presented. of testing which continues the authors' work on application of AGT method to estimating induction motor's efficiency are discussed. The proposed method is verified in a number of selected low-power motors.

Abstract

In this study, low-carbon cast steel was reinforced with TiC by SHS-B method, also known as combustion synthesis during casting method. The composite zone was then subjected to surface remelting by Gas Tungsten Arc Welding (GTAW) method. The remelting operation was realized manually, at 150 A current magnitude. Microstructure, phase composition and hardness of remelted zone were investigated. XRD results reveal that the phases of the composite zone in initial state consist of TiC and Feα. Surface remelting resulted in formation of thick layers containing TiC carbides, Feα and Feγ. Microstructural examination has shown strong refinement of titanium carbides in remelted zone and complete dissolution of primary titanium carbides synthetized during casting. The average diameter of carbides was below 2 μm. The structural changes are induced by fast cooling which affects crystallization rate. The hardness (HV30) of the remelted layer was in the range between 250 HV and 425 HV, and was lower than hardness in initial state.

Abstract

Advancements in technology and material sciences lead new solutions to be used in civil engineering. PolyUrethane Flexible Joints (PUFJ) and Fiber Reinforced PolyUrethanes (FRPU) are among those innovative solutions. PUFJ implemented systems comprise of seismic preventive buffer material between masonry infill walls and reinforced concrete (RC) frames, whereas FRPU solution is designed for covering the wall surfaces with thin composite strips. Both methods are primarily developed for increasing the ductility capacities of buildings while sustaining the overall structural strength without compromising on the safety of these systems against earthquakes. In this article, test results of the quasi-static cyclic experiments as well as dynamic tests on the shake tables including harmonic forces operating in resonance are presented. Moreover, numerical analyses are performed in order to comprehend the behavior of PUFJ implemented frames constituted with different masonry materials than above which are under various loading conditions. The outcomes confirmed the high efficiency of the proposed solutions, which at the same time meet the strict requirements of the modern seismic standards.

Abstract

The aim of our study was to determine the influence of L-carnitine (L-CAR) on the cellular parameters of hen erythrocytes during a 48 hour exposure to L-CAR at concentrations of 25, 50 and 100 mg/mL in nutrient-deficient medium. Cell morphology, haemolysis, caspase 3/7 activity and glucose uptake (GU) were determined. The results showed a lower percentage of apoptotic cells and decreased haemolysis of erythrocytes treated for 48 hours at all the concentrations of L-CAR. The amino acid at 50 mg/mL inhibited the activity of proapoptotic caspase 3/7; however, it increased GU. In contrast, caspase 3/7 level was increased but GU was decreased in erythrocytes treated with 100 mg/mL of L-CAR when compared to the control. It may be hypothesized that reduction of apoptotic changes in hen erythrocytes may result from increased GU.

Abstract

The dynamic replacement columns are formed by driving a coarse-grained material into a soft soil by means of repeatable drops of a pounder. The final shapes of the columns are non-cylindrical and depend on the subsoil conditions. This paper presents results of the laboratory study on influence of the thickness of the soft soil on the displacements of the backfill aggregate during the driving process. A test box with one acrylic-glass wall was prepared, in which, over a load-bearing sand layer, a soft soil of various thicknesses (���� = 0.3, 0.4 or 0.5 m) was modelled using a semi-transparent acrylic polymer. The displacements of the backfill gravel particles were tracked by means of a high-speed camera. The material was driven by dropping a 0.2 m high (����) pounder. The results revealed that the distance between the bottom of the first crater and the top of the sand layer played an important role in directing the particles. At ����/���� = 2.5 pear-shaped floating columns were formed as the grains in the side zones were less affected by the pounder drops and their paths deviated from the vertical axis by not more than 50°. In case of ����/���� = 2.0 and 1.5, the column bases reached the bearing layer and the impact energy caused much larger vertical and horizontal displacements of the backfill material in the side zones – the observed largest angles were equal to 64° and even 90°, respectively. Eventually, the final column shapes resembled a non-symmetrical barrel and a truncated cone.
