Abstract

An analysis of the regulations of this extensive normative act that governs maritime civil law prompts the author to some critical comments. The result of these criticisms are suggestions for the modification of several norms of the Maritime Code. It is the view of the author that, despite the fact that the new legislation has only recently come into force, an urgent revision is necessary. Part of the proposed changes concern minor mistakes that arose at the final stage of the legislative process. There are, however, also proposals that go further, e.g. the removal from the legislation of the new institution of the Polish yacht register. In total, the author presents more than 50 changes to the new Maritime Code. Along with such revisions, the author also proposes new solutions which have not hitherto existed in the Polish Maritime Code. An example of such a proposal is that of introducing into the Maritime Code the obligation of financial security for ship owners responsible to cover damage done by pollutants other than crude oil. Besides arguments in favour of particular proposals for legislative changes, the article contains concrete outlines of new regulations.

Abstract

This article discusses different types of maritime arbitration. In the introduction, the author distinguishes between ad hoc arbitration and permanent courts of maritime arbitration. The author draws attention to the fact that not every institutionalization of arbitration means that we are dealing with a permanent court of conciliation. In addition, the role of maritime courts of conciliation is changing because inter alia an increasing amount of business arbitration is dealt with via proceedings in maritime cases. Next the article discusses the structure and procedural principles of many examples of maritime arbitration. The author divides these into the following: the Anglo-Saxon group (London and new York arbitrations); the European group (The Maritime Chamber of Arbitration in Paris, the ICC/CMI Arbitration regulations, The German Court of Arbitration, The Dutch Court of Arbitration, The Russian Maritime Arbitration Commission); and the Eastern group (examples of arbitration in China, Japan, Singapore, and India). One of the author's conclusions is the necessity of referring to the subject of maritime arbitration in the new Polish Maritime Codex which is being prepared by the Maritime Law Codification Commission.

Abstract

In recent years, more and more attention has been paid to the quality of produced coal size categories for energy purposes. This is important from the perspective of promoting clean coal technologies which aim at changing the perception of coal as a fuel friendly for the environment. This is specifically because hard coal resources in Poland allow the national energy security to be guaranteed on the basis of energy production based on hard coal. Fine coals upgraded at coal processing facilities in the separation process in fine coal jigs are mainly used in energy production from coal. In the article, an analysis of hard coal upgrading in a jig regarding the optimum recovery of a useful fraction in the concentrate (combustible and volatile matter) and non-useful fraction in tailings (ash and sulfur) was conducted. Based on the industrial testing of a fine coal jig, the granulometric and densimetric analysis of the taken samples of concentrate, middlings and tailings of coal was conducted in laboratory conditions. Yields of products were calculated in separated size-fractions of separation products, and ash content and total sulfur content were determined in them. Based on the results of granulometric, densimetric and chemical analyses of the obtained size-fractions, the balance of separation products and appropriate calculations, Fuerstenau upgrading curves which allowed the process to be evaluated and a comparison of the results of hard coal upgrading regarding the optimum recovery of the organic phase in the concentrate and mineral components in tailings to be drawn. The obtained results were evaluated on the basis of different criteria for changing the device’s hydrodynamic operational conditions. The ash content and total sulfur content were analyzed as non-useful substances.

Abstract

The author discusses systematization of scientific disciplines. He presents two methods of systematization, namely: classification which uses logical divisions, and typologization which relies on Weberian method of defining ideal types. Faced with certain weaknesses of the classification and typologization, the author proposes still another method of science systematization, which he calls ‘theoretical positioning’. Such systematization is accomplished by defining a selected theory with respect to the research processes employed in it. At the time when interdisciplinary studies are becoming more and more popular, theoretical positioning is a useful method of systematization for research purposes. It arranges scientific disciplines in an order that displays their theoretical affinities. That method of systematization not only organizes the multitude of scientific disciplines but also indicates which areas of cooperation can be most promising. Alongside that study, the author also discusses the possibility of theoretical positioning of sciences by employing conceptual categories used in theory of action which, appropriately conceptualized, could serve as effective interdisciplinary instruments.

Abstract

In this paper, thermally-excited, lateral free vibration analysis of a small-sized Euler-Bernoulli beam is studied based on the nonlocal theory. Nonlocal effect is exerted into analysis utilizing differential constitutive model of Eringen. This model is suitable for design of sensors and actuators in dimensions of micron and submicron. Sudden temperature rise conducted through the thickness direction of the beam causes thermal stresses and makes thermo-mechanical properties to vary. This temperature field is supposed to be constant in the lateral direction. Temperatures of the top and bottom surfaces of the system are considered to be equal to each other. Governing equation of motion is derived using Hamilton’s principle. Numerical analysis of the system is performed by Galerkin’s approach. For verification of the present results, comparison between the obtained results and those of benchmark is reported. Numerical results demonstrate that dynamic behavior of small-sized system is been effected by temperature shift, nonlocal parameter, and slenderness ratio. As a result, taking the mentioned parameters into account leads to better and more reliable design in miniaturized-based industries.

Abstract

At the turn of the 20th century, the January Uprising of 1863 was one of the focal points of Polish collective memory, shared by the Polish communities abroad. Their press marked the subsequent anniversaries of the Uprising with due solemnity, highlighting its importance for the history of the nation and seeking to engage its readers in a common show of respect. Editors of the Polish-language newspapers in the USA followed the same line, using the commemoration as a means to consolidate the unity of the Polish-American community.

Abstract

This paper discusses the issue of just transition and presents the general directions of Poland’s energy transition until 2040. The just transition plays an important role in the process of Poland’s green energy transition and not without reason – it is the first pillar of Poland’s Energy Policy until 2040. Therefore, the paper attempts to discuss the legal, economic and social aspects of the planned changes. The next part of the paper describes the just transition from the level of the European Union. It points out what challenges member states are facing and what actions they will have to take to meet the transition requirements set by the European goal of climate neutrality by 2050. Particular attention was paid to the activities of the European Commission, which is particularly involved in the process of transforming the European Union’s energy mix. This issue is extremely important for our country as it is going to be the major beneficiary of the EU transition fund.
The penultimate section discusses research performed from 15 to 20 February 2022 on a group of 120 people living in different regions of Poland. The respondents answered a series of questions about general aspects of the energy transition, a just transition as well as the risks resulting from following the European Union’s climate and energy trends. Based on the answers provided, pie charts and bar graphs have been produced in order to make the analysis of the issues discussed clear and understandable. The whole study was concluded with a summary.

Abstract

The functioning of European economies and societies requires a stable and sustainable supply of mineral resources. For 10 years now EU has been developing raw materials initiative to secure European minerals supply. In many cases, areas with known or hypothetic mineral resources, are not sufficiently valued by society and authorities, remain unprotected and face competing land uses with the risk of becoming sterilized. MINATURA 2020 project was born out of a need to develop a harmonised framework which allow a common way of identifying “mineral deposits of public importance” (MDoPI) and their safeguarding via land use planning. The project has left a useful set of guidelines and proposals how to advance on the creation of a European network of MDoPIs to avoid sterilization of “deposits worth safeguarding”.

In Poland, the need for legal protection of mineral deposits has been discussed intensively in recent years. Various proposals aimed at better system of mineral deposits safeguarding, especially those which should be recognized as of public importance, have been proposed. However, until now only a few coal deposits were recognized as strategic. Currently, the Polish National Mineral Policy is under preparation. Its overriding objective is to provide access to the necessary minerals, also in the longterm perspective. It assumes among others activities aimed at protection of mineral deposits regarding land use planning system.

Paper presents scope and general results of MINATURA2020 project, with details on MINATURA2020 methodology implementation in Poland, Project of the Polish National Mineral Policy with its objectives and key pillars, position of MDoPIs in this Project, and – finally – expected future steps related to MDoPI safeguarding in EU and in Poland.

Abstract

This paper describes and tries to explain return intentions of Polish, Romanian and Bulgarian labour migrants in the Netherlands. Previous research has often emphasised the temporary or ‘liquid’ char-acter of Central and Eastern European labour migration. We find that a substantial number of labour migrants intend to stay in the Netherlands for many years, and sometimes forever. Data from a survey of Central and Eastern European (CEE) labour migrants (Poles, Romanians, Bulgarians) in the Neth-erlands (N = 654), is used to test three hypotheses about return intentions. Economic success or fail-ure is not found to be related to the return intentions of migrants. Apparently, some migrants return after being successful in migration, whereas others return after having failed. Migrants with strong links with Dutch society have less strong return intentions, whereas migrants with strong transnation-al ties intend to return sooner.

Abstract

Four small (surface area: 0.4-2.3 ha), but relatively deep (max. depth: 6.5-7.8 111) man made reservoirs, created between 1979 and 1988 on recultivatccl waste heap of former sulphur mine in Machów (N 50°31'35": E 21°37'51")_ were studied in summer and autumn 2003. In autumn one lake - Kacze was not mixed down to the bottom, which could point to its meromixis. The other lakes were found to be dimictic. In all the lakes high values of total hardness, conductivity, chlorides, sulphides and low amounts 01· total phosphorus and nitrogen were found. Both phytoplankton and hydrornacrophyte communities were poorly developed. Considerable amounts or green-yellow bacteria were also noted in plankton The water chemistry as well as quantity and quality of plant communities reflect the chemical composition of loam soils which constitute the waste heap.

Abstract

The global development of electromobility and the innovation of life are becoming increasingly noticeable. A direct implication of this is the increase in demand for modern products and services, their components and thus the raw materials necessary to produce them (e.g. cobalt, lithium, rare earth metals). In the European Union (EU), raw materials related to strategic sectors – renewable energy, electric mobility, defense and aerospace and digital technologies – show a very strong dependence on import throughout the entire value chain. In the case of eleven out of thirty of the so-called critical raw materials (CRM), necessary for the energy transition, the EU’s dependence on import exceeds 85%. Global supply chains, which had already been strained, were further affected by the COVID-19 pandemic and the exacerbated geopolitical situations leading to even greater shortages of critical raw materials in Europe and leaving the industry facing challenges in securing access to resources. An implication of this was the European Parliament’s position on critical raw material legislation in September 2023, which called on the EU to increase its processing capacity across the value chain and enable the production of at least 40% of the annual consumption of strategic raw materials by 2030.
Growing importance in the transition to a low-emission economy is attributed to cobalt (Co), which is an essential component both in the production of electric vehicles (EV), stationary energy storage and in the developing sectors of wind energy, fuel cell systems and hydrogen storage technologies, robotics, unmanned vehicles (drones) and 3D printing as well as in digital technologies. Securing the supply of such raw material is crucial for the European Union’s economic resilience, technological advantage and strategic autonomy.
The purpose of this article is to present and analyze the concept of value chains as strategic models of long-term development and ensuring efficiency from a sustainable perspective. According to the authors, a detailed analysis of value chains may enable defining strategic directions of action and identifying the risks of their disruption or interruption. To give a practical dimension to the presented analyses, the example of the cobalt value chain is provided and the determinants of its functioning on the current market along with development prospects are indicated.
